DMCA Policy

TikInsta (https://tikinsta.net) respects the intellectual property rights of content creators and copyright holders. In compliance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws, we have established the following policy for addressing claims of copyright infringement.

1. Our Role as an Intermediary

TikInsta is a technical intermediary service. We do not host, upload, store, or distribute any media content on our servers. Our service retrieves publicly accessible content from third-party platforms (TikTok, Instagram, Facebook, Pinterest, SoundCloud) and streams it directly to the requesting user in real time.

Because we do not store or host content, traditional DMCA takedowns targeting hosted files do not apply in the conventional sense. However, we take copyright concerns seriously and will review all legitimate notices submitted to us.

2. Reporting Copyright Infringement

If you are a copyright owner or authorised agent and believe that TikInsta is facilitating access to content that infringes your copyright, please send a written DMCA notice to our designated agent at:

  • Subject Line: DMCA Takedown Notice — [Your Name / Copyright Work]

3. Required Information in a DMCA Notice

To be considered valid, your DMCA notice must include all of the following:

  • Your identity: Your full legal name, email address, and (if different) the name of the copyright holder you represent.
  • Identification of the work: A clear description of the copyrighted work you claim has been infringed, with enough detail to identify it.
  • Infringing content location: The specific URL or page on tikinsta.net that you believe facilitates access to the infringing content.
  • Good faith statement: "I have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law."
  • Accuracy statement: "I declare, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorised to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  • Signature: Your physical or electronic signature.

Notices that are incomplete, vague, or submitted in bad faith will not be actioned. Submitting a false DMCA notice may expose you to legal liability under 17 U.S.C. § 512(f).

4. Our Response to Valid Notices

Upon receipt of a complete and valid DMCA notice, TikInsta will:

  • Review the notice within a reasonable timeframe (typically 3–5 business days)
  • Investigate the identified URL or feature
  • Take appropriate action, which may include blocking access to the relevant content or URL pattern
  • Notify the submitter of the action taken

5. Counter-Notice Procedure

If you believe that content was disabled or action was taken in error (e.g., you are the rights holder or have a licence to use the content), you may submit a counter-notice to dmca@tikinsta.net.

Your counter-notice must include:

  • Your full name, email address, and physical address
  • Identification of the content that was disabled and its previous location
  • A statement under penalty of perjury that you have a good faith belief the content was removed or disabled as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district in which TikInsta may be found)
  • Your physical or electronic signature

6. Repeat Infringer Policy

TikInsta operates a repeat infringer policy. In appropriate circumstances, we reserve the right to disable or restrict access to the service for users or third parties who are found to be repeat infringers of intellectual property rights.
